What to Do When DHR or CPS Shows Up Unannounced – Protecting Yourself Legally and Emotionally

1. Stay Calm—Don’t Panic or Overreact

Your instinct might be to slam the door or demand to know why they’re there. Resist that. Anger or panic can be misinterpreted as a red flag. Instead, remain calm, polite, and firm. Don’t invite them in just yet. Ask for their full name, their agency, and whether they have a court order or warrant.


2. Do They Have a Warrant? You Have the Right to Ask

In Alabama and most states, DHR or CPS cannot force entry into your home without a court order unless there is an immediate and verifiable danger to a child. You have the right to ask, “Do you have a warrant or a court order?” If not, you can politely decline entry.


3. Don’t Talk Too Much—Every Word Counts

Even if you feel innocent, avoid oversharing. Anything you say could become part of their file. Keep your answers short, factual, and respectful. Do not speculate or defend yourself emotionally. Just acknowledge their presence and let them know you would prefer to speak with your attorney before any further steps.


4. Do Not Sign Anything Without Legal Review

They may try to get you to sign a release or safety plan. Do not sign anything—no matter how harmless it sounds—until you’ve had a qualified attorney review it. These documents can sometimes include consent to remove your child or waive your legal rights.


5. Immediately Call a Family Law Attorney

Don’t wait. Whether you think this is a misunderstanding or something more serious, a lawyer can help control the narrative from the beginning. Your attorney can communicate on your behalf, attend any interviews, and make sure you’re not being manipulated into giving up your rights.


6. Document the Visit

Write down everything—who showed up, what they said, what time, how long they stayed, and whether they had a warrant. If they attempted to enter without your consent or pressured you, note that. This information is crucial for your attorney and can protect you in later proceedings.


7. Be Extremely Cautious on Social Media

During DHR/CPS investigations, your Facebook, TikTok, and Instagram can be used against you. Avoid any posts about the situation. Lock down your privacy settings and alert close friends and family not to share details or speculation online.


8. Know That False Reports Happen All the Time

Often, these visits stem from a bitter ex, an angry neighbor, or a well-meaning teacher who misunderstood something. Don’t assume you’ve done something wrong. But do take it seriously and respond smartly.
