Served with a Restraining Order? How to Respond Without Ruining Your Case

Being served with a restraining order—whether it’s called a PFA, protective order, or stay-away order—isn’t just shocking. It’s legally dangerous.

Too many people panic, get emotional, or try to explain themselves… and end up handing the other side the evidence they need. One mistake could mean lost custody, jail time, or a permanent mark on your record.

Here’s what to do instead:

1. Freeze Communication No texts, no emails, no DMs. Even if the allegations are false, even if your ex tries to provoke you—do not respond. Silence protects you.

2. Read the Order Line by Line Every word matters. Is there a hearing date? Custody provision? Firearm restriction? Don’t assume. Know.

3. Lawyer Up Fast You don’t need “any attorney.” You need a family law attorney who understands both civil defense and the custody implications. This is a custody landmine in disguise.

4. Document, Don’t React Start keeping a timeline of events, saving screenshots, and noting patterns of manipulation or retaliation. Evidence wins—not emotions.

5. Prepare for the Hearing Like It’s Trial Because in many ways, it is. You need to look composed, credible, and prepared. No drama. Just facts.

If you need the full survival strategy—legal, emotional, and tacticalget the guide I wrote just for this moment titled: "Served with a PFA or Restraining Order – Now What?" This guide walks you through step-by-step on what to do and mistakes to avoid, how to defend against this. Get the Guide!
