My Baby Momma Won’t Let Me See My Kids – What Are My Rights?

If the mother of your children is blocking you from seeing them, you’re not alone—and you’re not powerless.

Every day, fathers across the country get shut out of their children’s lives out of spite, revenge, or pure control. Maybe there’s no court order yet, maybe she’s ignoring the one that exists, or maybe she’s playing games during exchanges. Either way, the pain is real—and so is the legal path forward.

Let’s talk about what you can do.

1. Do You Have a Court Order?

If there’s already a custody or visitation order in place and she’s refusing to follow it, you can file a motion for contempt. Courts don’t take kindly to parents who willfully violate court orders and interfere with the child’s relationship with the other parent.

Judges can issue makeup time, fines, or even modify custody in your favor if the violations continue.

2. No Court Order Yet? File for One—Immediately.

If you haven’t been to court yet, now’s the time. Even if you're on the birth certificate, you have no enforceable rights until you get a formal custody order.

In most states—including Alabama—unmarried fathers must establish paternity and petition for custody or visitation through family court. Once you do that, the court will set a schedule the mother is legally required to follow.

3. Document Everything.

Every denied visit, every nasty message, every ignored call—document it. If she’s interfering with your parental rights, a judge will want proof. Keep texts, screenshots, and a journal. If your child is old enough to express themselves, note what they say after missed time.

4. Don’t Take the Bait.

No matter how angry you are, don’t lash out. Avoid threats, name-calling, or blowing up her phone. She may try to use your reaction against you in court. Keep your cool and let the evidence speak for you.

5. Get Legal Backup.
