Hiring an attorney isn’t always an option—but when your grandchild’s safety is at risk, you can’t afford to do nothing. The good news? In many cases, grandparents can fight for custody without a lawyer—and succeed.


Family courts understand that some situations require quick action. If the child is living in an unsafe home, being neglected, or exposed to violence or addiction, you may have standing to file for custody. In Alabama and many other states, courts allow grandparents to file pro se (without legal counsel) if they can show the child’s best interests are at stake.

You’ll need to prepare carefully:

  • Visit your local family court clerk and ask for custody forms

  • Fill out a Petition for Custody and attach evidence

  • Ask for emergency custody if there’s immediate danger

  • Serve the parents and appear at your hearing ready and calm

The process can feel intimidating—but it’s doable. And when your grandchild needs you, it’s worth it.
