What Alabama Law Says About Grandparents’ Rights
In Alabama, grandparents don’t automatically have a right to visitation. The courts presume that fit parents make decisions in the child’s best interest, including who the child sees. That said, Alabama Code § 30-3-4.2 does allow grandparents to petition for visitation under specific circumstances.
You may be eligible to ask the court for visitation if:
One or both parents are deceased.
The parents are divorced or legally separated.
One parent has had their parental rights terminated.
The child was born outside of marriage, and paternity is legally established.
The grandchild was adopted by a stepparent or other relative.
But even if one of these applies, the court must still be convinced that visitation is in the child’s best interest—and that denying you time with your grandchild would cause actual harm to their emotional well-being.
Proving Harm Isn’t Easy—But It’s Not Impossible
Courts are cautious about overriding a parent’s decision to cut off contact. But you can show that you’ve had a strong, consistent, and emotionally meaningful relationship with your grandchild—one that has been unfairly cut off without cause.
To strengthen your petition, gather:
Evidence of regular contact or visits (photos, texts, call logs)
Affidavits from other relatives or family friends
Records showing your involvement (school pickups, doctor visits, holidays)
Any communication where the parent acknowledges your role
The more you show that your absence is harming the child—not just upsetting to you—the more seriously the court will take your case.
Don’t Wait Too Long to Act
If you delay, the parent may argue that the child has “adjusted” to life without you, weakening your case. Courts also take consistency and stability seriously, so waiting too long to file could backfire.
